Terms of service
Last updated November 1, 2026
These terms govern your use of this website and, unless a signed statement of work says otherwise, the services provided by Kino Growth LLC. By using the site or engaging us, you agree to them.
Use of this website
The content on this site is provided for general information. You may read, link to and quote it with attribution. You may not republish substantial portions, resell access, or use automated tools in a way that degrades the service for others.
No guaranteed outcomes
Search and answer-engine results are controlled by third parties. We do not guarantee rankings, citations, traffic, conversion rates or revenue. We commit to the work described in a statement of work and to reporting against an agreed baseline — not to a specific commercial result unless a separate written guarantee says so.
Estimates and examples
Case studies, benchmarks and figures on this site describe past engagements or independent research. They are not predictions of future performance for your business.
Engagements and fees
Client engagements are governed by a signed statement of work that specifies scope, fees, payment terms and the term of the engagement. Unless stated otherwise, fees are invoiced monthly in advance, exclude media spend and third-party tools, and are payable within 14 days.
Intellectual property
We retain ownership of our methodologies, templates, internal tooling and pre-existing materials. Deliverables created specifically for a client transfer to that client on full payment, except for materials we license from third parties. Our name, logo and brand assets remain ours.
Confidentiality
Each party will keep the other’s non-public information confidential and use it only to perform the engagement. We will not publish a client name, metric or case study without written permission.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential damages. Our total liability under an engagement is limited to the greater of the fees paid in the three months preceding the claim or the amount specified in the statement of work.
Termination
Either party may terminate an engagement for material breach that remains uncured 14 days after written notice, or as otherwise provided in the statement of work. Fees for work performed remain payable.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in San Francisco County have exclusive jurisdiction.
